Surface Pro 128GB ‘sells out’ instantly, but customers aren’t buying it

For a company to successfully sell its latest gadget, it takes a lot more than merely having a good product. It also has to make sure there’s plenty of units in stock all across the country so fans can actually buy it. This is where Microsoft may have misstepped. Yesterday, the software-turned-hardware maker announced on its blog that it had almost instantly sold out of 128GB Surface Pro tablets, but is the sell out due to brisk sales, or lack of supply?
Nearly 100 customers have taken to the comment section of the Microsoft blog to vent their anger over the notion that the tablet has sold out (as of this writing). Some commentators report as few as “one device for show and one for sale” in Staples and Best Buy stores in their state.
“Like many others I tried to order online and in the stores,” said a commenter named Gormly. “At Midnight the website was still not showing for sale, I tried for 30 minutes then all of a sudden sold out online. Before they even opened for business all Best Buy show unavailable.  My 3 local Staples received 2 64gb versions each. Just two. There are 1050 Best Buy stores in the US, there are 1575 Staples stores, Staples seems to have received an average of 2-4 unit and best buy 6-8.”
Other commenters were more harsh, calling for Microsoft to fire its PR team and the author of the blog post, Panos Panay, Microsoft’s General Manager in charge of Surface.
“I have been a faithful Apple customer since the launch of the Gen1 Iphone,” wrote a commenter named Ericinsales. “I have stood in lines for 4 different launches. These lines had several hundred people in them. Everyone of those people took home the model they wanted to purchase. I was never turned away. This was an Epic fail on your teams part …. This was a poorly executed launch and people should be fired. I am in sales and I understand the pressure MS is under, however this is no way to treat your clients. You guys failed and you need to own it. The limited response coming out of the MS camp does not cut it. You made us wait in anticipation for 3 months, you dropped the ball.”
Microsoft hasn’t been doing very well in its PR department lately. In the past few months, fans and the media have fumed about Windows 8 and Microsoft’s limited storage capacity in its new Surface Pro tablet, which the company has done little to curb tension over.
While Microsoft has not told us just how many Surface Pros have been sold yet, some estimate that less than 30,000 were in stock across Best Buy and Staples stores. Creating artificial demand is an age old tactic, but it’s never good to brag about a product being out of stock and allude to a nationwide sellout when you did not adequately supply stores. Some commentators report as few as “one device for show and one for sale” in Staples and Best Buy stores across their state.
We have not reviewed the Surface Pro just yet, but stay tuned as we hope to have our thoughts on it soon. Whether or not we love or hate it though, Microsoft is not having a great weekend. While a mistake in logistics is easy to correct, the real tragedy is the little we’ve heard yet from the company on its efforts to curb concerns from its customers. Microsoft should consider responding to its fans. If not, it may risk ruining any future the Surface Pro may have ahead of it.

At this stage in the game, it’s kind of hard to imagine a world devoid of smartphones. The crazy convenient devices have become so engrained in our lives, there’s no chance of them going anywhere anytime soon. In fact, according to a recent study by ABI research, by the end of 2013, the number of active smartphones around the world will total around 1.4 billion.
Leading the pack will be Android, claiming 57 percent of the entire smartphone market. No surprisingly, following will be iOS, staking claim to 21 percent. Windows and Blackberry may not have hugely competitive numbers in the grand scheme of things, but they are still expected to be key players. It’s expected that some 45 million Windows phones in use, with the new Blackberry 10 being used by a surprising 10 million users.
So what does this even mean? First of all, it’s a clear indication that more and more people are continuing to rely on their phones as a primary means of all types of communication. But more importantly, it’s a sign that both Windows and, maybe even more surprisingly, Blackberry, are still strong contenders in the grand scheme of things. (The latter being the most surprising, since their latest launch is the first cutting edge cellular release from the company in quite some time.)
This could also be a determining factor in the app world. Developers are much more likely to spend their time focusing on platforms that will drive more eye balls, but, knowing that the two underdogs are gaining traction, it could very well mean that we will soon start to see an increase in the proliferation of apps for both Windows and Blackberry, both of which are severely lacking.

Judge tosses 13 Motorola patent claims against Microsoft

The team of Google and Motorola Mobility has suffered a major setback in one patent war against Microsoft.


 


 
A federal judge in Washington state has invalidated more than a dozen patent claims in the case of Microsoft v. Motorola.
Right now the winner (of this particular skirmish) is Microsoft over Google-owned Motorola Mobility.
On Wednesday, Judge James L. Robart of the U.S. District Court for the Western District of Washington in Seattle, issued an order in favor of Microsoft, invalidating 13 patent claims.
Those claims are in reference to just three patents (U.S. Patent No. 7,310,374, U.S. Patent No. 7,310,375, U.S. Patent No. 7,310,376) -- all of which have to do with encoding and decoding digital video content.
Microsoft had petitioned that the "means for decoding" and the "means for using" elements of the patents in question be declared as invalid based on a specific U.S. patent law specification, and the court has consented.
Following up a detailed technical analysis of the petition, here's an excerpt from Robart's order explaining his decision:
Finally, as stated, decoding and encoding are entirely different functions. Thus, even were a person of ordinary skill in the art able to devise an algorithm for decoding the function from the disclosed encoding description, that alone does not rescue the disputed means limitations from indefiniteness. Were that the case, any means-plus-function limitation could be saved from indefiniteness by an expert's testimony that he or she could have written computer code to perform the recited function based on unrelated disclosures in the specification. The specification needs to provide a decoding algorithm from which to base the understanding of one skilled in the art, and the court can find no such algorithm within the specification. Instead, the "means for decoding" limitations claim all corresponding structure under the sun by expansively defining the function in the specification as anything that decodes digital data. This definition renders the "means for decoding" limitation invalid for indefiniteness.

However, there are still more claims related to this trio of patents waiting for a ruling.
FOSS Patents' Florian Mueller explained a bit further, predicting on Thursday that these claims could also still be denied.
Most patent claims are actually invalidated for anticipation (lack of novelty) or obviousness (lack of inventive step over the prior art). Such questions can be decided on summary judgment but most of the time are put before a jury, while indefiniteness is for a judge to decide.

Mueller added that if any of these claims are upheld in Motorola's favor, Microsoft still might have a chance to license them under FRAND (fair, reasonable, and nondiscriminatory) terms.

SEATTLE (Reuters) - The new Windows 8 system is off to a "solid" start and should get a boost in sales over the next few months as new touch-screen devices hit the market and Microsoft Corp hones its retail strategy, according to a top executive. The flagship product of the world's largest software company, launched on October 26, has not set the technology world on fire. By early January, it had sold more than 60 million units, on par with the release of Windows 7 three years before. "We're only just getting started, there's a lot yet to come," said Tami Reller, chief financial officer of the Windows unit, in an interview at Microsoft's campus near Seattle. "Touch laptops and convertibles, we're really just starting to see these and over the next couple of selling seasons we'll have them across all form factors and all price ranges." Reller highlighted new tablets from Acer Inc and lightweight laptops from Hewlett-Packard Co as machines capable of grabbing a share in a mobile computing market dominated by Apple Inc's iPad and Google Inc's Android. She thinks new devices will answer demand for Windows 8 that was thwarted over the Christmas period by the scarcity of the most popular machines, partly caused by constrained supply of touch-screen components. "At holiday there were certain devices that were limited in their volume. We sold out of a lot of the most interesting things," said Reller. NO SURFACE NUMBERS YET Microsoft has still not revealed the number of Surface tablets it sold since the device's launch alongside Windows 8, but research firm IDC last week put it at 900,000. That is much lower than analysts' initial estimates and a fraction of Apple's almost 23 million iPad sales last quarter. The second of two Surface devices launches this weekend, running on an Intel Corp chip and capable of running all legacy Windows programs, which might appeal more to businesses. "You launch Excel and you can just see things fly," said Reller, who has been using a Surface Pro for the last two weeks. A Forrester Research survey published on Monday showed that only 2 percent of "information workers" around the world are using Windows tablets for work, but 32 percent indicated they would like one for their next work tablet, which could translate into 200 million sales of Surface and other Windows tablets. One selling point of the Surface Pro is a full suite of Office applications, which means Microsoft can market the tablet as a fully functional PC. Microsoft has not released Office for the iPad, although many expect it will eventually. POST-SINOFSKY COLLABORATION Reller, a 12-year veteran of Microsoft, runs the financial and marketing side of the Windows unit, while Julie Larson-Green runs the technical side. Reller and Larson-Green took over the unit after the unexpected departure of Windows head Steven Sinofsky in November. Microsoft hinted that Sinofsky's successors would stress integration and collaboration between business units, especially Windows and Office, which has been strained in the past. "I am very happy with where our relationship is with the Office team," said Reller. "Both Julie and I have worked closely with the Office team. We worked closely together when Steven (Sinofsky) was here and even closer now." Reller said collaboration was already happening under Sinofsky, citing the creation of Bing, Xbox and Office apps for Windows 8, and close co-operation with Microsoft's server and tools unit, which enables Windows 8's "cloud" services to operate. "More has not changed than has changed," said Reller. "We probably had a day of getting ourselves oriented and maybe a few weeks to get fully oriented, but things are moving." Announcing Sinofsky's departure in November, Microsoft Chief Executive Steve Ballmer wrote an internal memo stressing a new goal to "drive alignment across all Microsoft teams," suggesting co-operation had not always been a success in the past. "Steve's reference was, 'Let's take that base (of collaboration) and just keep going," said Reller. "And that's happening." IMPROVE RETAIL Microsoft spent hundreds of millions of dollars promoting Windows 8 and Surface last quarter, but consumer interest at third-party stores such as Best Buy Co Inc tended to focus on Apple and Android products, according to a Reuters survey of shoppers in mid-December. Some in the PC industry have complained privately that Microsoft has not done enough to train sales people or educate consumers on the new range of devices running Windows 8. "I think we can do better and we'll work with them (retailers) to do better," said Reller. "That's not a criticism of our retailers. But we are definitely going to do more at retail to make that experience better." Overall, Reller was happy with progress in the 90 days or so since Windows 8 launch. "This is a solid start. But we are just getting started," she said. "We have a lot of reasons to be optimistic."

    F.T.C. Suggests Privacy Guidelines for Mobile Apps

    WASHINGTON — In a strong move to protect the privacy of Americans as they use the Internet on their smartphones and tablets, the Federal Trade Commission on Friday said the mobile industry should include a do-not-track feature in software and apps and take other steps to safeguard personal information.
     
    Path, a mobile social network, lets users keep online journals that can be shared with a limited group of family and friends.
     
    Jon Leibowitz, the F.T.C. chairman, said the mobile industry should let users opt out of having their online activities tracked.
    The staff report, which was approved by the commission, is not binding, but it is an indication of how seriously the agency is focused on mobile privacy. As if to emphasize that, the commission on Friday separately fined Path, a two-year-old social networking app, $800,000. It charged the company with violating federal privacy protections for children by collecting personal information on underage users, including almost everyone in users’ address books.
    Together the actions represent the government’s heightened scrutiny of mobile devices, which for many Americans have become the primary way of gaining access to the Internet, rather than through a laptop or desktop computer.
    “We‘ve been looking at privacy issues for decades,” said Jon Leibowitz, the F.T.C. chairman. “But this is necessary because so much commerce is moving to mobile, and many of the rules and practices in the mobile space are sort of like the Wild West.”
    The report lays out a clear picture of what sort of activities might bring a company under investigation — like, for example, conveying the impression that an app will gather geolocation data only one time, when, in fact, it does so repeatedly.
    For companies like Apple, Google, Microsoft, Amazon and BlackBerry (formerly Research in Motion), the suggestions essentially carry the weight of policy.
    But the F.T.C. also has its sights on thousands of small businesses that create apps that smartphone users can download for a specific service. The introduction of the iPhone created a sort of gold rush among start-ups to create apps featuring games, music, maps and consumer services like shopping and social networking.
    “This says if you’re outside the recommended behavior, you’re at a higher risk of enforcement action,” said Mary Ellen Callahan, a partner at Jenner & Block and former chief privacy officer for the Department of Homeland Security.
    Morgan Reed, executive director of the Association for Competitive Technology, a trade group representing app developers, said that the organization generally supported the commission’s report but that it had some concerns about what he called “unintended consequences.”
    If app stores are worried about their own liability over whether they have adequately checked the privacy protections of a mobile app they sell, they might err on the side of caution and not screen for privacy at all, he said.
    The federal recommendations follow a similar set of guidelines issued last month by the California attorney general, whose tips effectively set the standard for technology companies nationwide, given the state’s huge consumer market.
    The trade commission and the Obama administration last year issued separate sets of recommendations for safeguarding consumers’ online privacy, and the subject has attracted growing concern in Congress.
    But most of the focus to date, particularly with do-not-track policies, has been on Internet browsers commonly used at home but not on cellphones. Do-not-track features let users request that their footsteps not be followed as they move around online.
    The commission and the administration have begun to focus on mobile data privacy partly because smartphones let so many entities gain access to personal information, including wireless service providers, mobile operating system developers, handset manufacturers, app companies, analytics outfits and advertisers — “a degree unprecedented in the desktop environment,” the report said.
    The activities of Path, a company in San Francisco, illustrate some of the F.T.C.’s concerns. The company developed a social networking app that allows people to keep an online journal about moments in their lives, including written entries, photos, music to which they are listening and their location. A user can share a journal with up to 150 people. The app has been installed more than 2.5 million times.
    The F.T.C. asserted that Path, without alerting its users, had engaged in deceptive practices because it routinely collected and stored information about the contacts in users’ address books. The privacy policy that Path provided to consumers said it collected limited, mainly technical information about users’ devices.
    In fact, the commission said, Path was collecting personal details including addresses, phone numbers, usernames for Facebook and Twitter, as well as dates of birth.
    The company also collected some of that information from users who, in signing up for the service, indicated that they were under age 13 without permission of their parents or disclosure of how it would use the information — violations of rules adopted under the Children’s Online Privacy Protection Act.
    Path, without admitting or denying the accusations, agreed to pay an $800,000 fine and to comply with the children’s privacy act, destroy already collected children’s information, follow its own stated privacy policy and have its privacy efforts monitored by an outside party.
    In a statement posted on its Web site, Path said that “there was a period of time where our system was not automatically rejecting people who indicated that they were under 13.” But even before the F.T.C. contacted the company, Path said, “we discovered and fixed this sign-up process qualification and took further action by suspending any underage accounts that had mistakenly been allowed to be created.”
    The F.T.C. staff report, which was approved by a 4-to-0 vote, with one commission member not participating, recognized that steps were already being taken to adopt best practices for privacy protection. Among them is the creation of a group, Moms With Apps, which developed a badge icon to alert parents to the advertising and data-collection practices of apps aimed at children.
    Even before this report, “the F.T.C. has not been meek,” said Lisa J. Sotto, managing partner of Hunton & Williams in New York. “They have brought a number of enforcement actions,” she said. “Those in the mobile ecosystem know they’re in the regulators’ sights.”
